Sales terms

  1. A sale only comes into effect after written confirmation by the Seller. A start in the fulfillment of the Order will be taken into account as a confirmation, unless it has been made under reserve(s).
  2. Each and any order cancellation has to be confirmed in writing and will only come into effect after written acceptance by the Seller. In case of a cancellation, a forfaitary amount of 20% of the Sales Price will be due.
  3. The Sales Terms are given by way of information only and are therefore not binding unless explicitly agreed to. Any delay in fulfillment of the Order cannot be taken into account as a means of obtaining damage payment or cancellation of the Order.
  4. Transport and insurance are for the account of the Customer, unless explicitly agreed otherwise.
  5. The Buyer is required to accept and inspect the goods upon arrival. Complaints are only valid if they have been sent by Registered mail. Complaints that are received within a period of 8 days after receipt will no longer be accepted.
  6. Hidden defects will only be taken into account as a cause for possible damage payments if they have been identified within 3 months after receipt, by Registered mail. The goods may not have been processed or treated.
  7. The goods supplied will remain the property of the Seller until the sales price has been fully paid, including costs and interest.
  8. Transferrance of risk becomes effective the moment the goods leave our warehouse(s).
  9. The Buyer will inform the Seller if the goods are stored in a rented space. The Buyer will have to inform the Seller about the identity and adress of the owner of the property.
  10. Invoices are payable in cash, unless otherwise agreed in writing.
  11. Non-payment on the expiry date of our Invoices will legally and bindingly result in damages due to the Seller of 10% (with a minimum of 50¤). No default notification will be required in order for these damages to become effective. Negligence interests of 12% will also be due, or the legal interest as stipulated in the law of 02.08.2002 regarding the settlement of late payments in commercial transactions, should this be the higher.
  12. In case of dispute, only the courts in the legal district in which our company is registered will be competent. All our transactions fall under Belgian Law.
  13. Each and every order automatically implies that the Customer agrees to our Sales Terms.
  14. In the cases where the law of September 1st. 2004 regarding consumer protection whilst buying consumer goods is not applicable, following rule applies : through the receipt or the taking along of the goods the Buyer explicitly agrees that the goods qualify as these ordered and are apparently free from visible defects. Any other defects should be reported in writing, within a month of their discovery. In the case(s) where the abovementioned law does apply, the customer is required to inform the Seller of the apparent non-compliance within 2 months upon establishing said non-compiance. Faillure to do so invalidates any possible claim.

Return of goods

The consumer will have the right to cancel the purchase, without extra costs, within a period of 7 days after the contract has been signed, provided he informs the Seller by Registered mail. Any clause whereby the consumer should be denied this is null and void. With regards to the adherence of said period, it will be sufficient if the notification is sent before term expiry.

AB Jewelry Piercing only sells the highest quality goods and only wants satisfied customers. Any article bought from us can be returned within 7 days should you not be satisfied with it, provided the goods are still in their original and unopened packaging. Returned goods can only be accepted if they have not been used. Each return can be refused on grounds of hygiene, therefore returns should only happen with the consent of AB Jewelry Piercing. Because we are absolutely certain of the quality of our products, we also issue an extra guarantee of 3 months on any returned article.
